Please read these Terms of Use carefully. By submitting an order form, you agree to be bound by Oahu Print Co. (hereafter OPC) terms and conditions.

Terms of Sale: All prices and amounts shown on this site are in U.S. Dollars, unless otherwise noted. Full payment is required with each order. User agrees that all charges, taxes, shipping and processing fees will be automatically charged to the credit card, or paid by customer with an approved method of payment. In the event of litigation the parties agree that such action will be brought in the county of Honolulu, HI. If an action is commenced to enforce payment, buyer agrees to pay seller’s attorney’s fees, court costs, and other costs of collection. All returned checks will be charged a fee of $25. We reserve the right to change prices and fees at any time without notice. All prices on approved orders will remain the same.

Refund Policy: All sales are final, no refunds are available on orders unless work has not been started and the refund is requested the same business day. Refunds may take up to 21 business days to be issued.

Errors: OPC cannot be held responsible for files that are not submitted properly. OPC does not check any submission for spelling, grammar or any other type of error, the design will be printed as it appears on the Proof during the approval step. OPC is not to be held financially responsible for delays or missed deadlines resulting from any technical, mechanical, or human errors. Due to the nature of printing, allow adjustment for error to ensure perfection. Ultimate responsibility to check such errors such as but not limited to: Full bleed, Text and content out of zone, Spot UV alignment, Spelling Errors and typos, Color out of gamut is yours.

Apparel: OPC cannot be held responsible for any loss due to delays that may be caused by mechanical or human error; damages to apparel due to defects from manufacture or mechanical defects and misprints of any kind.

Vehicle Graphics: OPC cannot be held responsible for any type of damages to the vehicle during the application or removal process of the vinyl graphics. OPC will not be held liable for any damages to the paint, clear coating, etc., or damages of any kind to the vehicle during the prep, removal, or install process. OPC will not be responsible for any long-term damage to the graphics with exposure to the sun, rain, debris and/ or time. Client should have proper insurance to cover any damages sustained to vehicle while in the possession of OPC.

Color Accuracy: OPC will reproduce color from submitted images or digital layouts as closely as possible, but cannot guarantee exact match color and density. We accept no liability of any kind for color variations between submitted images and the actual artwork or product they represent.

Indemnification: The customer will indemnify and hold harmless the printer, OPC, and its subsidiaries, affiliates, officers, directors, employees, and independent contractors, from any and all loss, cost expense, and damages, on any and all manner of claims, demands, actions and proceedings that may be instituted against the printer on the grounds alleging that said printing violates any copyright or any proprietary right of any person. User certifies the right to use the image(s) in their artwork file and accepts full legal liability for the content of material submitted and processed.
Under these Terms & conditions, customer agrees NOT to upload any artwork files consisting of any material that could give rise to any civil or criminal liability under applicable law; any material that could infringe rights of privacy, publicity, copyrights, or other intellectual property rights without the permission of the owner of these rights.

Website Design: Every endeavor will be made to ensure that the website and any scripts or programs are free of errors, OPC cannot accept responsibility for any losses incurred due to malfunction, the website or any part of it. The website, graphics and any programming code remain the property of OPC until all outstanding accounts are paid in full. Any scripts, cgi applications, php scripts, or software (unless specifically agreed) written by OPC remain the copyright of OPC and may only be commercially reproduced or resold with the permission of OPC. OPC cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.

Any additions to Statement of Work or Assessment provided will be carried out at the discretion of OPC and where no charge is made by OPC for such additions, OPC accepts no responsibility to ensure such additions are error free and reserve the right to charge an according amount for any correction to these or further additions.  The client agrees to make available as soon as is reasonably possible to OPC all materials required to complete the site to the agreed standard and within the set deadline. OPC will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.

OPC will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrongdoing on the part of a site owner. (eg. Any disputes re:content/images that have been provided to us for inclusion on the site.) OPC will not be liable for any costs incurred, compensation or loss of earnings due to the work carried out on behalf of the client or any of the clients appointed agents.

OPC will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material provided by its agents.  A deposit of 50% is required with any standard project and 65% for database driven projects before any design work will be carried out. This figure may be higher for websites of an adult nature and is non-refundable. Once a website has been designed and completed the final balance of payment is then due in accordance with our payment terms. There are no exceptions to this, (i.e if the client decides they no longer want the site, as they have commissioned the work and paid a deposit they are still obliged to pay for the work that has been done.) Non-payment will result in legal action being taken if necessary.

IMPORTANT! Failure to Provide Required Website Content: You must ensure that we are not delayed as a result of late delivery of the material and content required to complete your website.

This is why we ask that you provide all the required information in advance. On any occasion where we are delayed because you have not provided this information, we reserve the right to impose a surcharge of 25% of the total cost of the work. Also, if your job involves Search Engine Optimization, we need the text content for your site in advance so that the SEO can be planned and completed efficiently.
If you agree to provide us with the required information in advance and subsequently fail to do within four weeks of project commencement we reserve the right to close the project and the balance remaining becomes payable immediately.

Database, Application and E-Commerce Development: OPC cannot take responsibility for any losses incurred by the use of any software created for the client. We shall see every care has been taken to ensure products are problem free and accurate, the ultimate responsibility lies with the client in ensuring that all software is functioning correctly before use.  Any scripts, applications or software (unless specifically agreed) written by OPC remain the copyright of OPC and may only be commercially reproduced or resold with the permission of OPC. Where applications or sites are developed on servers not recommended by OPC, the client is expected to provide or seek any information, additional software, support or co-operation pertaining to the server required in order for the application to be correctly developed. Where large applications are to be developed, it is the clients’ responsibility to provide a suitable testing environment which is identical to the final production environment.

The client is expected to test fully any application or programming relating to a site developed by OPC before being made generally available for use. Where “bugs”, errors or other issues are found after the site is live, OPC will endeavor (but is not obliged to) to correct these issues to meet the standards of function outlined in the Statement of Work or Asessment.

Website Compatibility: OPC will endeavor to ensure that any developed/designed site or application will function correctly on the server it is initially installed in and that it will function correctly when viewed with the web browsing software Mozilla and to an acceptable level with Microsoft Internet Explorer, Safari, Google Chrome, and Mobile browsers. OPC can offer no guarantees of correct function with all browser software.

Website Hosting: OPC recommends hosting companies to self-host their website as no guarantees can be made regarding the availability or interruption of the hosting service. OPC cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss. OPC recommends a third-party security on the website hosted server.  OPC reserves the right to refuse to handle in any way, material which may be deemed offensive, illegal or in any way controversial, and also to terminate any hosting service should the necessity arise.

OPC reserves the right to refuse any order, which, in our opinion, may be illegal in nature or infringe on the rights of any third party.

Delivery: Quoted turnaround times start when OPC verifies your approved order/ Proof, not from when your order is first submitted. Turnaround times vary, they are estimated and are not guaranteed. OPC will not be held responsible for delays due to any circumstances such as breakdown of equipment, power outages, etc.

Order Changes: Once approved Proofs and/or an Estimated Invoice is in production and it is ready for press we cannot accept replacement files or order changes; orders can no longer be cancelled or placed on hold; no changes can be made to quantity, adding or deleting items, and/or changing color schemes.

Sales Tax Hawaii: All Hawaii orders are subject to sales tax. If a customer is tax exempt, exemption certificate must be provided to us before first order.

Templates, Material and Samples: All materials we create in producing your job are the property of OPCmpany. These materials will not be sold or given to any other party. We reserve the right to distribute free samples of your printed piece and use your artwork in our advertising. Free downloadable design template files in formats of Photoshop, Illustrator, and InDesign, may not be redistributed in any manner without the express written consent of OPC.

Mailing Services & Every Door Direct Mail Services (EDDM): Please note that in providing Mailing and EDDM Services, OPC, neither makes any representation or guarantee as to the results you will achieve from using the Services, nor does it act as an agent, partner, joint venture, or in any other capacity on your behalf or on behalf of the United States Postal Service® (“USPS”). Delivery time averages from seven (7) to twelve (12) business days, however OPC, makes no guarantees in this respect. All issues related to delivery of mail are matters solely between the USPS® and yourself.

Miscellaneous: The internal laws of the State of Hawaii shall govern the performance of these Terms and Conditions, without regard to such state’s conflicts of laws principles. You consent to the exclusive jurisdiction and venue of the courts located in Honolulu, Hawaii for all disputes arising out of, or relating to, the Terms and Conditions and use of this Site. OPC, reserves the right to update and modify these Terms of Use without notice, therefore we encourage you to review it each time you use this website.

Coupons: Coupons cannot be applied to orders containing custom quotes or towards mailing services. Expired coupons are not valid. Tax and delivery charges are not included when calculating minimum purchase requirement. Special services including, but not limited to, UV coating, shrink wrapping, and folding, will not be subject to coupon code discount. Coupons are not valid on previous purchases. Coupon Codes can NOT be combined with other coupons, unless otherwise specified. OPC, reserves the right to withhold coupon code promotion(s) at any time without prior notification

Satisfaction Guarantee: Customer satisfaction is very important to us and we are committed to high quality standards. However, there are some conditions beyond our control that are not covered by this guarantee: Errors made by the customer, incorrect shipping address, undeliverable packages, or other errors created by the customer, and damages to the products arising after delivery to the customer.

This guarantee does not cover fees for mailing services, postage or associated incidental or consequential damages or claims. OPC, is not liable for U.S.P.S. errors, including loss or delay. We (OPC, subsidiaries, affiliates, officers, directors, employees, and independent contractors) are not responsible for any damages or claims incurred by you or your business caused by receiving printed materials which are defective or incomplete or which you receive later than the estimated delivery date.

Please review your design carefully prior to submitting your order. In an effort to keep our costs low and provide you with a fast turnaround time, OPC, does accept any liability for error of any kind. Proof your artwork prior to printing.
